Question:
I am a public school educator that is taking a course on legal issues
in education. I have been asked by the course instructor to look into the
issue of drug testing in schools (grades K-12). Most of what I have found
has centered around drug testing high school athletes and school system
employees like bus drivers or bus maintenance workers where safety issues
are the stated concerns.
Is anyone in this group knowledgeable about any school systems that
test students other than athletes or other employees like the teachers? I
have come across the Supreme Court opinions on the drug testing of high
school athletes as being constitutional, but I have found no information or
legal opinions on the testing of an entire student body at a school or with-
in a school system or on the testing of an entire faculty.
If you know of any such situation, I would be most appreciative of
any info you can steer me towards. Anecdotal info will be welcomed as well.
Thanking you in advance for taking the time to consider this request.
and opinions are welcome.
Answer:
What should be the further actions upon the test results? Should students be
removed because they smoke MJ? Or if they refuse to show a prescription for
their cough sirup if they test positive on opiates? If no action is taken why
should they be tested at all?
IMO no actions should be taken against anyone if she takes drugs and has and
causes no problems due to that. Help might be offered to drug users, but help
could be offered to everyone, not only to users of illigal drugs.
