Anyone know the current law on drug testing of students, without linking it
to athletics or extracurriculars?
My impression is that general drug testing of students is illegal under the
4th Amendment, as an unreasonable search and seizure, unless there is
specific basis for it with respect to a specific student. Correct?
Answer:
IANAL, but my understanding is that a public school does not have the
authority to perform random drug testing on the general student population.
I would tend to question the Control Freak mindset of a school district that
desired to do this, if it were legal.
